‘Review bid in guise of clarification’: SC registrar junks govt plea on 2G

NEW DELHI: SC’s registrar has refused to accept the application filed by the Union govt seeking clarification of the 2012 judgment in the 2G spectrum case for allowing administrative allocation of spectrum in some special cases.
Registrar of judicial listing Pavanesh D refused to accept Centre’s miscellaneous application and said, “From a perusal of the prayer made in the application, it is clear the applicant intends to seek review of the order passed by the SC in the guise of filing the present application.” “When the application is considered keeping in mind the principles laid down by this court, it is clear that the same is not maintainable and it does not disclose any reasonable grounds to be entertained,” his order said.

Noting that SC had already refused to review its 2012 verdict, the registrar said, “Applicant is again attempting to obtain rehearing of the matter in open court after a long lapse of time, in the guise of filing the present application with a similar prayer which was already made in the

review petition

filed by the applicant.”
“I am of the considered view that application is misconceived… The pronouncement in the judgment of Feb 2, 2012, does not entitle the applicant herein to file an application of this nature seeking clarification of the judgment… more so, when review petition filed on behalf of the Union of India seeking review of the law (laid) down by SC was withdrawn on May 10, 2012.”
