A Division Bench of the Kerala High Court recently set aside the Kasaragod Additional District and Session Court’s order sentencing Misiriya Rehman to life imprisonment for murdering her husband’s second wife.
The incident took place on August 7, 2011. The prosecution case was that Misriya had poured petrol through the window of a room on Nafeesath Misiriya and her husband, Abdul Rehman, where they were sleeping, and set them ablaze. Both of them sustained severe burns and Rehman’s second wife, Nafeesath Misiriya, succumbed to her injuries at a hospital in Mangaluru.
Acquitting the accused, the High Court observed that the prosecution had failed to prove beyond reasonable doubt that the accused had committed the homicide of the deceasedNafeesath Misiriya.
